12. DISPUTE AND CLAIMS COMMITTEE Continue.....

 

Section 25(6) provides as follows "The Commission may delegate any of its functions contemplated in this section excluding matters related to Kingships or Queenships to a Committee referred to section 26A of the Act."

 

Section 26()1) provides as follows "There is hereby established Provincial Committees to deal with disputes and claims relating to Traditional Leadership.

 

The Committee has to investigate and make recommendations on the following:

a case where there is doubt as to whether a senior traditional leadership or headmanship was established in accordance with customary law and customs;

 

a case where there is doubt whether a principal, senior traditional leadership and headmanship was established in accordance with customary law and customs;

 

a traditional leadership position where the title or right of the incumbent is contested;

 

claims by communities to be recognized as principal traditional communities, traditional communities, or headmanships;

 

the legitimacy of the establishment or desetablishment of "tribes"or headmanships;

 

disputes resulting from the determination of traditional authority boundaries as a results of merging or division of "tribes";

 

all traditional leadership claims and disputes dating from 1 September 1927 to the coming into operation of provincial legislation dealing with traditional leadership and governance matters; and

 

gender related disputes relating to traditional positions arising after 27 April 1994.
